Civil Litigation - Procedures Explained
When a dispute between two or more parties becomes and remains unresolved, it often ends up in court. For people who have never been in court the entire process can seem confusing. It needn’t be - we have the experience to advise you of all options open to you and can assist you with all stages. There are three different tracks that a case may take in court:
- Small Claims Track - for when the claimant is seeking an award equal to no more than £5000 -
- Fast Track - for when the person filing the claim is seeking an award that exceeds £5000 but is less than £15000
- Multi Track - court claims that are in excess of £15000 or that will result in a lengthy trial with substantial documentation.
There are however other factors that differentiate which route a claim may take and should your claim develop into a complex case the assistance of a reliable solicitor is paramount.
If the findings of the litigation are not acceptable then it may be possible to appeal the decision and we can advise if an appeal is possible and help where appropriate.
The outcome of most civil litigation is a financial penalty against the loser of the case but enforcement of such penalties can sometimes be more difficult than any other part of the litigation. The court has set procedures for enforcing compliance and we can explain the avenues available and assist in the pursuit of same.
